A U.S. federal judge issued a ruling to halt actions taken by President Donald Trump's administration regarding non-citizen voters, in a move that represents a new judicial setback for the administration's efforts to expand federal authority over election management, amid concerns that these actions could disenfranchise legally eligible voters from exercising their constitutional right.
U.S. District Judge Tanya Chutkan decided to prevent the Departments of Justice and Homeland Security from sending lists to states containing the names of registered voters that the administration claims may not be U.S. citizens, and she also prohibited requiring state election officials to segregate ballots from these voters or refrain from counting them until their citizenship is proven.
The ruling comes at a time when the Trump administration is facing a series of legal setbacks related to its attempts to impose more federal oversight on the electoral process, ahead of the midterm elections scheduled for November 3, during which Republicans are fighting to maintain their majority in both houses of Congress.
In contrast, the U.S. administration achieved a legal advance in a separate case, after a panel from the Ninth Circuit Court of Appeals, based in San Francisco, allowed the government to threaten local election officials and state officials with criminal prosecution if they do not comply with demands related to alleged voting by non-citizens. However, this ruling does not bind Judge Chutkan, who issued an independent ruling in the case before her.
U.S. law prohibits non-citizens from participating in federal elections, but available evidence suggests that this practice is extremely rare.
Nevertheless, Trump continues to accuse states, which are legally responsible for managing elections, of being lax regarding non-citizen voting, as part of allegations he has previously linked to his unproven claims of fraud in the 2020 presidential election, which he lost to his Democratic opponent.
Last month, the Trump administration intensified its pressure on election officials by sending letters to officials in California and Washington, demanding that they not count any ballots belonging to individuals whose names appeared on lists the administration claimed may not be U.S. citizens.
In response to these actions, voting rights and privacy protection organizations filed a legal request to temporarily prevent the administration from sending those lists to the states or issuing similar demands, arguing that these actions violate the U.S. Privacy Act of 1974, which imposes restrictions on the federal government's ability to disclose sensitive personal information.
For its part, the Department of Justice defended its actions, asserting in a legal memorandum submitted on Saturday that the letters sent to California and Washington are part of efforts to enforce federal law prohibiting non-citizen voting, and that they do not represent an independent policy subject to judicial review.
In a related development, a federal judge in Los Angeles earlier this week rejected a request from the Department of Justice to compel California to segregate mail-in ballots sent to more than 20,000 registered voters, whom the department claimed are likely not U.S. citizens.
Judge Chutkan justified her decision by stating that the data the U.S. administration relies on may not be reliable, raising serious concerns about the exclusion of legally registered voters and depriving them of their right to vote without sufficient evidence.
A court of appeals had rejected on Friday the Justice Department's request for an emergency order allowing it to proceed with its actions pending the resolution of the appeal. On the same day, a federal judge in San Francisco issued a ruling requiring the Department of Justice to stop threatening state and local election officials with criminal prosecution for failing to comply with the administration's demands regarding alleged voting by non-citizens.
These developments reflect the escalating legal and political confrontation between the Trump administration and several states and organizations advocating for voter rights, amid a growing dispute over the limits of federal government authority in overseeing elections and its ability to intervene in voter registration and vote counting procedures, ahead of an electoral event expected to be crucial for the future of the Republican majority in Congress.
